What you propose is *definitely* a stretch. But if Vance commits some disqualifying acts, then that might indeed disqualify him, but only from that moment onwards, not his entire vice presidency (just like how there is no constitutional basis for voiding Trump's 1st term between 1/20/17 and 1/6/21)

Except JD is eligible to be Vice President, so he pretty unambiguously got a majority of electoral votes and is the legitimate Vice President. There is no need for the Senate to hold a contingent election for VP, only the House needs to hold a contingent for POTUS.

This idea is complicated by the fact that Harris didn't get a majority of electoral votes. So what should've happened, since nobody got a majority (arguably), is the House should've elected the President, which obviously didn't happen, so the Presidency is currently vacant.

The difference is, in 2008 Democrats had a blindingly obvious candidate that was all but assured to win the nomination (Hillary). This is the first time in a long while that the party doesn't have such an obvious candidate. This time they really are in a post-2012 GOP kind of situation.

I have a question tangent this (to Mr. @jamellebouie.net too, asking here cuz I can't otherwise): I (not American) have heard that the President can (constitutionally) summon Congress himself, and then force them on recess for as long as he chooses. Does that in any way factor into the whole thing?
