The article seems to imply that it's not admissible as evidence because it was recorded without his permission or knowledge, which isn't legal in the state it happened in. Based on the article, they may have bodged the investigation so badly it'll be hard to convict.

HOWEVER, human brains may be more densely wired, and so have higher processing power per gram
