It also doesn't make sense because a lot of "the familiar" did win elections! I don't think any of the incoming Democratic members of the VA House of Delegates decided to moonlight as an all-purpose charity in order to secure the biggest progressive majority ever in the old so-called Confederacy.

In Virginia (where they added contributory negligence as a defense to the Comp Act) it's arguably been breached! IIRC, that was one of the reasons why I think the teacher who got shot by a student at school was able to sue the district in fort.

Furthermore, "except in cases of impeachment" offers some rather interesting possibilities as well.

This is an area of law that has remained unexplored because it has suited everyone involved to *not* limit it. That is ending because we have a career criminal as President.

The other thing is that for previous pardons, iirc there's no dispute about provenance. A Post-BBD Pardon revealed absolutely has that problem, and will likely not be considered valid.

It starts with the old OLC Memo from the (iirc) Nixon Administration that the President cannot pardon himself because of the old English maxim "no one can be the judge of his own case". This gets extended to "The President, when conducting a criminal conspiracy, cannot pardon his co-conspirators".
