While this report closes a chapter, there remains a lot to unpack regarding the path forward for military policing and military justice, especially in the context of sexual violence. The Fortin case is not unique in this matter. Fin.

Its investigators seem to lack competence and accountability appears to be elusive. The CFPM's response to the recommendations are evasive and vague, leading the MPCC to consider most of them "partially accepted.

Finally, this report does not paint the Canadian Forces Provost Marshal in a positive light. The organization comes across as borderline obstructive in its refusal to provide the MPCC with documents with the least amount of redaction required.

There is also no evidence of undue influence from CAF leadership. While the Acting CDS and the DM at the time were concerned about the allegations, the MPCC did not see any attempts at interfering with the investigation.

That being said there was no evidence that no charges would have been laid if the investigation was conducted differently. The fact that a civilian prosecutor reviewed the investigation before charges were laid help in this conclusion

There were also issues related to proper oversight and proper following of authority lines by investigators. Left unaddressed: why was a Sgt lead investigator while a WO was assisting, and why did seemingly junior investigators took the lead on such a high profile case?

The report does found that the CFNIS failed to follow proper practices, e.g., not interviewing certain witnesses, failing to record calls and interviews and taking substandard notes, and overlooking certain discrepancies (and showing unconscious biases).

While a written policy says little about how it is implemented in an organization, this gives us additional data as to what has been causing the backlog in applicants with PR, beyond clearance challenges.
