I think that ends up being a false etymology, too. ב–ר–כ shows up in many Semitic languages, all with the meaning of blessing but not with the related meaning of kneeling.
That having been said, the notion that it comes from ברֵכָה is also clearly wrong.

The implication of Wurman's claim is that state officials can do whatever they want, and the only time judicial intervention is justified is ex post, subsequent to a person being legally injured.

I simply don't understand the logic. He is treating it like a lawsuit w/personal standing. But this is a judicial review of a state official exercising a public power, whose lawfulness can be challenged in courts. SCOTUS is dropping (or punting) the ball, but this is a classic function of courts.

This is an ahistorical understanding of the term. It was a neologism coined in 19th century Germany specifically to refer to discrimination against Jews *not* on the basis of their religion, but as a race/ethnicity.
While those are Semitic languages, they are not the subject of the term's meaning.

Just to take stock: the first claim was that there was an entire literature supporting the anti-birthright position. Then, *after* that claim, scholars emerged to post drafts on SSRN. And *now* the government points to a "growing body of modern scholarship" all drafted after the initial claim.
