That balance is what the SUN Act (S.2803) tries to clarify.
It would require the President to report to Congress within 15 days of any domestic Guard deployment — explaining the legal basis, cost, and objectives.

Under Title 32, the Guard answers to the Governor.
Under Title 10, it’s federalized — meaning the President commands it, and Posse Comitatus limits apply.
