In summary, the President acts as the primary enforcer of the Supremacy Clause, using federal power to ensure compliance across states, but is bound by the constitutional requirement that such actions must conform to federal law and constitutional boundaries.

Foreign Relations: The President acts to maintain a uniform foreign policy, preventing states from creating their own foreign relations or interfering with treaties.

Immigration Enforcement: Presidents have used federal supremacy to deploy resources for border enforcement and to override state-level immigration restrictions.

Civil Rights: Historically, presidents have used federal force to override state-level resistance to federal desegregation laws.

Anti-Commandeering Doctrine: While federal law is supreme, the 10th Amendment limits the federal government's ability to force state officials to act as agents for federal enforcement.

Judicial Review: The Supreme Court ultimately determines if a presidential action violates the Constitution or exceeds authorized statutory authority, as seen in cases limiting presidential power (e.g., Youngstown Sheet & Tube Co. v. Sawyer).

Limits and Checks on Presidential Power
"In Pursuance" Clause: Executive orders and actions are only supreme if they are made "in Pursuance" of the Constitution and valid federal laws. An action not backed by valid law is not the "supreme law of the land".

It has a long history, But I came across a short synopsis that outlines the limits and checks on presidential power where the Clause is concerned, in today's world. It's not carte blanche for the president. Read on for the various scenarios. The last one is the kicker.

There are times when burning the flag may seem appropriate, but doing so is always a contentious act. Given how torn the country is right now, doing so may not be the best message. So maybe don't feed the Fox News propaganda machine. Take the high ground. We're all with you.

Get as crazy as you like with posters, banners, costumes and chants. Make it fun, vibrant, show them your heart and your resolve (less anger). The Flag: You can carry it upside down. You can wright on it, color it, wear it. Drag it on the ground and yes, burn it. It's all protected speech.

Taking a "passive" approach is not capitulation; it is a proven tactic. You can shout, you can sing, play your favorite protest songs. You can push free speech to the limit - which is quite broad. Threating bodily harm is a NO. Same for destruction of property. Lobbing fireworks also a NO.

If you are staging protests at ICE facilities define Go/No-Go lines. Do not give ICE agents an excuse to cross the line with pepper spray, flash bangs, or worse. They will try to bait you - do not respond. ICE have no training in crowd control, which makes them dangerous.

It ends up looking chaotic and dangerous and feeds the spin doctors in the White House. This is how we lose control of the narrative. MAGA eats it up with a spoon. Folks organizing protests need to be unequivocal about do's and dont's of protesting. Look back at the civil rights protests.

The administration can push out propaganda that would make Joseph Goebbels blush. Dem messaging will have to be nimble, timely, and sharp. State Attorney Generals should start drafting charges against Trump election interference now.

Time to get out of the pot.

We need to hold State Governors who maintain the same voting processes they have safeguarded for decades to continue to do so. We also need observers. These are "knowns", but there are so many "unknowns" not least of which is the threat that Trump will try to halt elections or declare them illegal.
January 14, 2026 at 10:20 PM
Time to exit the pot. Stop admiring the problem. The protests are great and should continue (I love them, and I also love that they render Trump apoplectic), but the mid-terms will be upon us soon and require more from us. We need serious candidates.

A personal gift for Putin to reconstitute the USSR and upend the European Union, which would likely trigger a global financial collapse (say goodbye to the benchmark US dollar). We get closer to to that brink every day.
I shudder to think what goes on in Stephan Miller's warped brain.

Like the frog pot, we've been swimming for months in EOs that swing from illegal to idiotic. The blatant racism, misogyny, dismantling of institutions. The lip service that masquerades as diplomacy and the not subtle threats of invasion/incursion into long-standing allied territory.

For those of you who are not familiar with the Jack Russell terrier and only know them for their cute appearance, the JRT stands out as the most relentless, and effective eliminator of barnyard vermin.
WE ARE JACK RUSSELL TERRIERS!

Because if he did, he would have seen that most big productions are filmed in the US, as well as other countries - some in multiple locations! Same for post-production work. It's been that way for DECADES.
So good luck trying to square that circle, Donny.
