Iirc, the label was meant pretty capaciously (we also read Comedy of Errors, eg), and the point was that the threat of death hangs over the play until Theseus extenuates the law of Athens in act 4—which has made that the crux of the play for me ever since! (Why can he do it now but not in act 1?)
