The bitcoin etf was legit. The problem is genslers SEC over-extended its legal authority. If congress wants to pass a law regulating crypto, and they should, that’s how this works. Having an agency invent jurisdiction isn’t how it’s supposed to work

Ethereum I think gets the benefit of time, laches. It started out as a security. It isn’t today. There are definitely crypto securities. But bitcoin, ethereum, most NFTs, and many others are not. And ripple lost their suit.

There was a Bitcoin ETF case too. The SEC refused to define securities in the crypto context. Once companies could say bitcoin wasn’t a security they could compare other assets like ripple to it. But that took years of litigation

So they made impossible standards for companies to hit. They defined security so broadly that Pokémon cards or beanie babies would fit them. Then they took several years before they begrudgingly admitted Bitcoin wasn’t a security, and only after they lost a lawsuit. Just bad faith litigation

To be fair I followed the law fair against crypto…Gensler wasn’t only tough, he was frivolous in many cases using similar trumpian litigation tactics that’s being used more broadly now. I opposed those draconian tactics then and I oppose what the trump administration is doing now
