A court can be legitimate even when they make bad legal decisions.
The court becomes illegitimate when they no longer make legal decisions and utilize their authority to undermine the law. That taints everything they do.

I think a joint resolution by congress is enough to trigger the 14th amendment prohibition and congress should have done it. Let Trump and co-conspirators sue to try to reverse it.
