"Legal Moralism in Disguise in Child Custody Cases" is forthcoming in Family Law Quarterly (FLQ). Morality hasn’t disappeared from family courts but has taken on new rhetorical forms with courts judging parents’ choices on moral grounds w/o evidence of harm to child.

But you need to think of it as NW version of open enrollment (as opposed to the ACA marketplace version that’s longer than two weeks). What I’m trying to say is that NW might have an interest of less people changing their plans than the ACA architects who wanted to improve healthcare quality.

Open enrollment is aimed at fighting adverse selection. Because insurers are barred from turning people away for pre-existing conditions, the drafters of the ACA were concerned with the "enrolling in the ambulance on the way to the hospital" scenario. Come take my healthcare access/finance class :)
