His claim is that advertisers aren't advertising. The potential damages are pretty much defined by what *advertisers* know about Xwitter's user base because that's what their spend would be based on, not the real internal data about bots and fake users.

And that's why this whole kerfuffle is just Elon beating his chest and trying to look like a big internet tough guy for his fans; but he'll very quietly drop the case before he's forced to hand over anything that'll show the ADL's right. Hoping for a SLAPP countersuit that he can't run away from.

This case doesn't seem like it has anything to do with bots or fake users so it doesn't seem likely any discovery would be centered around that; but discovery would definitely reveal the scope (or more accurately, lack thereof) of Xwitter's efforts to measure and rein in hate speech.

Remember how Elon rolled over and submitted to Erdogan's requests without so much as a single complaint, claiming there was no choice but to obey government requests?
Seems there's only no choice but to obey when its a government he likes; he's perfectly fine resisting those he doesn't like.

It takes a special kind of dolt to make *Mark Zuckerberg*, basically the poster child for lizard people, look like the well-balanced party in a conversation.
