Regulation should focus on what the system does, ensuring that people are directly accountable for what it does, not on carving out space for the accountability laundering "innovation" necessary to protect a business model.
I think it's useful to ask:
* Could a human be hired to do this task?
* What licensing/training and ethical standards would be required?
* If an employee behaved in this way, would they be subject to discipline or legal liability?

Also: what would whistleblowing look like?
