Comey arraignment: Jan 5 trial date. Prosecutors wanted more time because they say there is a large amount of classified discovery material and the judge apparently seemed skeptical of that claim.

The defense will move to dismiss the case, arguing that the appointment of the prosecutor, Halligan, was unlawful. That motion will be decided by another court, Judge Michael Nachmanoff said.

The arraignment is over. Comey was not taken into custody, and there are no conditions on his release.

Lawfully obtaining phone toll records with a valid basis is not a crime.

Additional context on the two prosecutors…From my earlier digging, I knew they both came from the Eastern District of North Carolina. What I didn’t know was that they were still working there until recently and have been brought in for this case, presumably because no one from EDVA would do it.
The Justice Department brought in two new prosecutors for the case against James B. Comey, the former director of the F.B.I., according to court filings. The two U.S. attorneys, Gabriel J. Diaz and Nathaniel T. Lemons, prosecuted cases out of the Raleigh office in North Carolina until just a few weeks ago. Since President Trump ratcheted up pressure on career prosecutors at the Eastern District of Virginia in September to pursue the case on Comey, attorneys had resigned or been forced to resign.

Have any of the Republican senators on the Judiciary Committee heard of prosecutorial immunity? So many of them implied (or outright said) that Jack Smith and his team have legal liability for lawfully obtaining phone records.

Lindsey Graham: Called Georgia Secretary of State Brad Raffensperger in an attempt to throw out certain mail ballots. A Georgia grand jury recommended that he be indicted.
