Uganda has passed one of the harshest anti-gay laws in the world and is described as a living hell for lgbtq+ people. Meanwhile, the Netherlands strikes a deal with the Ugandan government to send rejected asylum seekers there.

Judgment also includes insights on 🇪🇺 #emergencylaw and #instrumentalisation

VG: Instrumentation practices do not, without further details, justify an invocation of Art 72 TFEU

Dismisses Gov’s appeal to COM(2024)570, simply noting that EC is not empowered to allow MS to set aside secondary law

🇩🇪 Excellent analysis of yesterday’s VG judgement re the unlawfulness of turning away asylum seekers

Yet another reminder that, for the law, any non-empirically substantiated asylum "crisis" rhetoric is nothing more than just that

Critical insight, also for the upcoming election campaign in 🇳🇱!

If sending asylum seekers to countries they have never been to, and have no connection with, is „respecting the EU’s values“, then I‘m really not sure what these values are anymore. ec.europa.eu/commission/p...

Should this part of the comm. then merely be seen as VDL pandering to disgruntled MS, knowing full well that any actual triggering of 72 will likely fail before the Court?

If so, another fine day for the rule of law in the EU 🤦‍♂️

To be continued, I suppose…
felixpeerboom.bsky.social
EC notes that such action would be “under the control of the Court of Justice”.

The same court that ruled in C-72/22 PPU, MA [para. 74] that MS could not rely on 72, as current rules already enable them to protect public order/nat. security without requiring triggering emergency Treaty provisions

Notable development 🇪🇺👀

While rationale of EU responses so far (in part) was avoidance of ad hoc domestic measures, in today’s comm. on ‘weaponisation’ EC itself suggests MS may invoke Treaty provisions (Art. 72 TFEU) to “go further than what is currently provided for by EU secondary legislation” 🤔
