Not sure I actually agree with that either. They're engaging in sophistry to make it seem complex when it really isnt. For example, they could've BOTH agreed w/ Trump's application of AEA & upheld Boasberg & 4th Circuit order to retrieve. They didnt because they didnt want to.

Another thing to bear in mind, the Trump administration does not need a court order to rectify their error. DOJ already admitted to their error! So, if DOJ had an ounce of decency, they'd retrieve him w/out being compelled.

The court determines what the law is. That's how it works. Again, if they wanted to remedy his improper removal, they could. They're not because they do not want to.

Basic American Civics. Basic jurisprudence.

Bullshit! They could be returned forthwith *IF* the court so ordered their retrievel and, THEN, habeas petitions could be filed. It's just that the court is CHOOSING to not order it. That's what's going on here.

Then, why bury it on SuperBowl Sunday?
