I‘m not sure thats right - because of building regs on the number of single sex toilets employers must offer, the Kelly approach (basing TERFs to use different ones) probably wouldn’t be compliant? As there wouldnt be enough ‘women only‘ toilets numerically

Ash you do know whether this case could theoretically go to the ECHR (once all domestic options are exhausted)?

Or would it need to be an actual Equality Act discrimination claim (eg Virgin Active)?

Yes, if you’re put at any disadvantage you aren’t being provided suitable facilities. That could be discrimination, but for them to change it you may need to bring a claim. If you do so it’s very unlikely you would ever need to pay their costs even if you lose, so you can only gain from it really.

I’m quite stunned by the ‘gossip’ comments about trans people. That needs to be a key feature of any appeal.

What is your assessment of the judge’s view that colleagues speculating over an employee’s genitalia is normal and tolerable ‘gossip’?

Would a trans employee commenting on a woman’s genitalia be tolerable gossip in your opinion?

One thing I’d appreciate clarity on - if an employer has single-sex toilets *and* trans inclusive ‘gendered’ toilets, can the latter be normal toilets or do they also have to be enclosed rooms?

I.e., is the ‘enclosed room’ requirement only where there are *no* single sex facilities?

Sort of. The decision was made by three judges, and the EHRC judge was one of them. But he didn’t lead the judgment.

If permission is refused on the basis that the update was withdrawn, that won’t be a ‘disaster’ it’ll just be a ‘status quo‘ mess. A ‘disaster’ would be a lengthy judgment stating that the guidance was right and that trans people’s human rights aren’t being violated, that’s the worst case scenario

I’m not Ashlee, but I am a lawyer and I wonder if this points towards a very simple procedural judgment saying ‘there is no need to consider the arguments because the guidance has been rescinded’.

Totally unpractical too - where would the wings be and who would finance them? - and there are so few trans prisoners that it could end up being permanent solitary confinement which would violate *other* human rights. They never think the implications through.

You may be mixing up the EHRC (the UK supposedly-independent human rights body) and the ECHR (European convention on human rights)
