What I blame Klobuchar this morning's post. I blame her for her silence specifically on Graham betraying the spirit of behind that post. When's she going to come out and say Graham has betrayed Ukraine in feckless fealty to Trump and, by extension, to Putin. It's been crickets from her since.

The blue stuff isn't actually blue, as the pic above is an enhanced color/false color pic meant to visually show differences in composition and texture of the surface. Here's a more accurate representation in true color, though I believe this shot may have the brightness tweaked up slightly.

I wanted to come back to this thread for information purposes. The Feds have charged him with a federal "murder through the use of a firearm" charge. This "worked" because the murder is tied by the complaint to another federal crime for which he was charged, namely, two counts of stalking.

A murder trial would be a state trial and would invoke NY State's stronger jury trial protections. In a criminal trial, a jury trial can only be waived by a defendant via a written instrument signed by the defendant in person in open court in front of a judge with jurisdiction to try the case.

Trial by jury in a criminal trial is protected by both the Federal (6th Amend.) and NY State (Art. 1, § 2) constitutions. As for hung jury mistrials, they could retry the case repeatedly, assuming the judge does not dismiss the charges.

A criminal defendant cannot be forced into a bench trial. He would have to waive his right to a jury trial in order for it to be a bench trial.
