Fraenkel had observed the rise of Nazi rule as a working lawver and committed social democrat and noted that ordinary Germans enjoyed the benefit of what Huq describes as a "capitalist economy governed by stable laws" even as other parts of the German system changed into an engine of genocide and war. The two components of the dual state are the normative state the seemingly normal world that you and I inhabit, where, as Huq writes, the "ordinary legal system of rules, procedures and precedents" applies - and the prerogative state, which is marked (in Fraenkel's words) by "unlimited arbitrariness and violence unchecked by any legal guarantees.'" "The key here," Huq writes, "is that this prerogative state does not immediately and completely overrun the normative state. Rather, Fraenkel argued, dictatorships create a lawless zone that runs alongside the normative state.' It's the continued existence of the normative state that lulls a population to sleep. It makes you discount the warnings of others. "Surely," you say to yourself, "things aren't that bad. My life is pretty much what it was.

Great piece (per usual) from Professor Vladeck re how to hold federal agents and officers accountable for unconstitutional conduct.
The most exasperating part of all of this is that fxing this problem would be the work of a one-sentence statute. Congress could simply subiject federal officers to the same liability that state and local officers currently face under 42 U.S.C. 1983. Alternatively, Congress could amend the law enforcement proviso in the FTCA to subiect the federal government (versus individual officers) to tort liability for all, or even some constitutional violations Or it could codify Bivens, specifically.

It is suspected that in many vehicle shooting cases, the subiect driver was attempting to flee from the agents who intentionally put themselves into the exit path of the vehicle, thereby exposing themselves to additional risk and creating iustification for the use of deadly force. In most of these cases, the agents have stated that they were shooting at the driver of a vehicle that was coming at them and posing an imminent threat to their life. In some cases passengers were struck by agents gunfire. Little focus has been placed on defensive tactics that could have been used by shooting agents such as getting out of the way. It The cases suggest that some of the shots at suspect vehicles are taken out of frustration when agents who are on foot t have no other way of detaining suspects who are fleeing vehicle. In most reviewed cases involved non-violent suspects who posed no threat other than a moving vehicle.
