In light of the Federal Court of Appeal's ruling on the Emergencies Act, I'm re-posting my discussion of the Crown's prerogative authority to keep the peace, which would have been far less onerous to exercise in dealing with the Convoy.

Question for those even more nerdy than me: is today the first time s. 18(1) of the Charter has been cited (own its own) by SCC? I know it's been cited before as part of the suite of rights in ss. 16-20...
