Ideology alone lacks sufficient explanatory power, it is particularly significant in accounting for extreme anti-enforcement responses. Arguably, this validates the tendency in the literature to approach the issue as state preferences rather than government preferences.

Early accession, high democratic quality and being a net contributor to the EU budget is the most reliable set of conditions for explaining pro-enforcement preferences. Governments of newer MS that are net recipients of funds tend to be more hesitant about enforcing the RoL.

Our findings show that preferences often remain stable, even when governments change. Thus, structural and semi-structural factors predict governments’ preferences on RoL enforcement better than ideological ones.
