This sort of thing is what tenure is really for. I am sitting on a plane chortling so loudly that I’m at risk of being removed for apparent drunkenness before we take off

The only thing I dislike about this review from the first couple of pages is that it raises the bar for truly savage reviews almost unattainably high. The Herculean amount of work it will take to outdo this is truly intimidating

For someone who occasionally claims to be a Dworkinian of a sort---and who hence has presumably heard of the idea of internal critique---it's actually a little shocking to see that Adrian Vermeule completely fails to understand that criticism can be a form of love and loyalty

So what he's saying here is that Roger Taney is part of that adoptive family which must be worshipped but Frederick Douglass and David Walker and and William Lloyd Garrison and other fantastic spewers of venom against the founders were not

This argument is downright crackhead goofy. If Alito is to be believed, Congress could enact a brand-new statute barring the military from doing law enforcement activity X, and *for that reason* it would immediately authorize trump to call up the national guard to do X.

Incidentally, you may recognize the most important time that a federal court went on a jag about who counts as part of the rights-bearing "people." And you may recall that this is one of the cases where the amendment process failed, and we had to have a bloody war.
