Seems like the pipe bomber could raise, in addition to the pardon argument, a selective prosecution defense given the broad way DOJ acted on Trump's pardon in other J6-related cases. /3

The DOJ clearly interpreted Trump's pardon to apply broadly - those in prison were immediately released of course, but DOJ also dismissed *pending* indictments and abandoned any remaining investigations, then fired or demoted any career prosecutors and FBI agents who worked on J6-related cases. /2

Good but flawed analogy: trump undoubtedly lacks Professor Gill's knowledge of history, also the professor was essentially being held captive, and I doubt Stephen Miller and JD Vance are sufficiently disciplined to pull that off.
