Maybe I'm missing something but the percentiles are set by the composition of the group. If you excise the bottom 10% or whatever it's mathematically necessary that the scores of the top decile will go up.

The most telling thing is how thoroughly they have repudiated "wear whatever you want" etc. Now if you are AMAB and dress "like a woman" you are predatory or deluded or both. And if you are AFAB and dress "like a man" it's your own fault when you get policed in a women's bathroom

GC feminists in particular--and for the OG ones of those "gender" means what radfems mean by it, they sought out to be critical of gender policing among other things--have done the extraordinary thing of reinventing the gender system from first principles by pounding so much on the importance of sex

right. it is not unanimous but the overwhelming trend in queer spaces is to be trans-inclusive. and now there's a good chance that it will be illegal in the UK for a gay or lesbian group to be trans-inclusive! wild stuff

one of the most jarring things in For Women Scotland is the court's extended discussion about what a trans-inclusive def of sex would mean for lesbians that seemed entirely unaware of the existence of non-trans-exclusionary lesbians

It doesn't foreclose two other arguments, though:
- maybe, post-FWS, an org for women based on self-id (rather than "sex") doesn't directly discriminate based on sex, so doesn't need the exception
- maybe the statutory exception doesn't require an absolute ban for people outside the characteristic

But that's FWS and you can see how it arguably poses a problem for a trans-inclusive group. FWS is saying that to fall within the exception, the definition of "sex" your group uses must track the definition in the Equality Act. The Equality Act's definition post-FWS is now "biological sex."
