paragraph 175 in west versus east germany is an interesting natural experiment, because you had two states start from the same legal code and similar culture, and you got to see whether it's better to be gay under communism or gay under capitalism

This National Strategy document cites the International Holocaust Remembrance
Alliance (IHRA) definition as the “most prominent” working definition of antisemitism that
the “U.S. has embraced.”1 We have been involved in recent efforts, particularly at the
federal level, to prevent the IHRA definition from being codified, because it defines
antisemitism so broadly that it could be interpreted to include criticism of Israel or support
for Palestinian rights—speech protected under the First Amendment.2 AB 715 now reflects
this broader national trend requiring the Antisemitism Coordinator to follow this working
definition when identifying antisemitism.

The IHRA definition of antisemitism is unconstitutional. Recently, in Students for Justice in
Palestine v. Abbot, the U.S. District Court for the Western District of Texas found that an
executive order directing all Texas higher education institutions to update and enforce
campus free speech policies to address antisemitic speech and apply the IHRA definition
of antisemitism likely violates the First Amendment. The judge found that “the
incorporation of [the IHRA definition of antisemitism] is viewpoint discrimination” because
it makes the utterance of a specific viewpoint or certain content punishable.3 Speech
that is critical of Israel or any other government cannot, alone, constitute harassment.
