Sure, but the indictment accuses him of "authorizing" a leak, not "instructing" some to leak. There are many other issues with the indictment, but one could argue that "authorizing" broadly encompasses knowing about something beforehand and/or approving of it afterwards.

I agree that the judge’s prose is a bit flowery, but I have to agree that transforming texts into strings of tokens and doing a ton of linear algebra with those strings to produce a totally different text is about as transformative as I can imagine.

I think you're also misrepresenting the judgment by focusing on the portion pertaining to the pirated works. Nobody is arguing that that's fair use. The judgment makes other conclusions, however--most notably, that training an LLM on (legally obtained) training copies is transformative fair use.

I agree. I read the ruling as saying:

1: For the purchased works (Anthropic spent millions doing so), training an LLM with them is inherently transformative and fair use.

2: For the pirated works, no fair use, and this separate issue will go to trial.

Hard to disagree with either point.
