Yulia Chernykh and I found empirical details to be fascinating in revealing the previously unseen dimensions of ISDS. One question our paper raises is whether awards are as final as we expect them to be under res judicata.

We are grateful for generous feedback from colleagues at COPIID www.jus.uio.no/ior/english/..., and participants of the workshop “Translucent Justice” at Luxembourg. Our paper raises further questions about transparency and its accountability dimension in the post-award phase of ISDS.
