Watch them tell the court they cannot effectuate Abrego Garcia’s return because he’s in the custody of a foreign nation.

That’s why they included that language.

Recall: Judge Xinis ordered daily status reports until her questions were answered in her Order.

IMO, so far only 1 of her 3 questions have been answered by the Trump Administration. Here’s her Order from Friday:
