Judge Brinkema asked the government what their position was; do they still have TPS, and if so, how are they being held?

The government said it was their position that they did still have TPS — a confusing answer given what DHS tried to do — then said they were being held as public safety threats.
THE COURT: All right. Thank you. Let me hear the government's response. Well, the first issue is the status of these two people right now today. Are they or are they not, in your view, still under temporary protected status protection? MR. MESSHER: As of today this morning, they have temporary protected status, the both of them. THE COURT: All right. And they will have it, at least through April 1st, is that correct? MR. MEZCHER: That is correct, Your Honor, yes. THE COURT: Then on what basis are they being held in custody zight now? MR. MESGHER: It is the position of Federal Respondents that they are subject to detention under & U.S.C. 1226 (a) because of the fact that they are a threat to public safety.
