If you are asking whether I would like to avoid a civil war the answer is yes, I would. However the threat of political violence by one faction does not invalidate the argument.

But it’s really radical to expect citizens to obey interpretations torn a court that says black is white or up is down. Or democratically passed laws are invalid because of some arcane jurisprudential theory. At some point you have to recognize the Constitution is a political compact not just law.

Yeah, I went to law school, too. But remember that it was Marshall who coined that phrase, which appears nowhere in the written constitution. And of course SCOTUS supremacy is the norm.

The question of which branch has the ultimate power to say what the Constitution means has been a core dynamic of the Republic since its founding. When the Supreme Court acts like a Supreme Council it id fair to ask, as Chris does, whether Congress should assert its prerogatives.
