Is Gorsuch citing the district court's findings of fact? Is he citing facts J. Kennedy argued but Bremerton disputed? Who decided these facts are true? If they are true, they contradict Gorsuch saying Kennedy prayed quietly while students were otherwise occupied.

Sure, hearsay if the kids didn't testify. But the test is whether a reasonable student would have felt coerced not whether any student actually complained of coercion. So Steve Kennedy can opine in this article the prayer was coercive. ...

These prayers occurred on a sports field with parents, students, other educators & later press as witnesses and videos as documents. Their testimony couldn't be dismissed as hearsay so Gorsuch just ignored it & the record developed by the lower court to create his own fact set. Like you're doing.
