Sending in the long-aggrieved 7tH Cavalry to disarm potential veterans of the Battle of Little Bighorn only exac- erbated tensions, and the fact that many of the troopers were raw recruits who had never been exposed to combat conditions no doubt played a role, as it did a My Lai seventy-cight years later. What happened at Wounded Knee was nothing more than what had hap: pened dozens of times throughout the brutal history of the Indian Wars. It was the result of perpetual misunderstanding, mistrust, and mistakes, of one culture exercising overwhelming advantage over another, of failure of leadership. Onco a preventable exchange became a full-blown firefight, not enough was done to stop it or to protect innocents. In this regard neither side was blameless. Was Wounded Knee a massacre? Like so much about the Indian Wars, there is no easy answer. The situation waS far too complex to boil down to a single word.11

Image 1 Linehan cleared of harassing trans activist but guilty of damaging phone, bbc.co.uk I am writing to let you know the outcome of the Executive Complaints Unit’s investigation into your complaint about an article on the BBC News website. You raised two separate points and so I propose to address each in turn. As you may be aware, the role of this Unit is to consider if the article met the BBC’s editorial standards, as set out in its Editorial Guidelines. I have therefore considered your concerns in light of the standards on Impartiality (Section 2), Accuracy (Section 3) and Harm and Offence (Section 5). Your first point of complaint was that the report misrepresented the case because it did not make it clear Graham Linehan's conviction was for an offence committed against a minor. The Editorial Guidelines require reports such as this to be duly accurate, which means the information given should be adequate and appropriate to the output, taking account of the subject and nature of the content. I have read the decision by the Judge at Westminster Magistrates Court and the age of the complainant, Sophia Brooks, does not appear to have been a relevant factor in her decision, apart from noting “I accept that the complainant was 17 at the time, 18 at the time that they appeared before me and a young witness. I accept that it is sometimes difficult to articulate oneself when appearing before a court and that is a stressful experience”. I therefore take the view the reference in the BBC News article to Ms Brooks as a “teenage trans activist” who was “17 at the time” met the requirements for due accuracy and did not result in readers being misled about the nature of the charges against Mr Linehan. Your second point of complaint concerned the description of Sophia Brooks which said she was “born a biological male but identifies as a woman”. Continues on image 2 Image 2 You said this was offensive and “clearly aligns with the ‘gender critical’ lobby”. I appreciate this is a subject on which you hold strong views and I am sorry you don’t believe the language used by BBC News was appropriate. However, I think it is reasonable to say it is a challenge for a news organisation like the BBC to report impartially and use language everyone considers acceptable; this is a polarising issue and any choice of words, framing or emphasis can be perceived as taking a side. What one audience member considers neutral or factual, may be regarded by another as incomplete or insensitive. Striking a balance between accurately conveying facts and avoiding language which may appear to reinforce one viewpoint over another is, therefore, particularly difficult given members of the audience may interpret coverage through their own perspective and may expect language which aligns with their personal views. The BBC aims for clarity so audiences, including those who may not be familiar with the nuances of the issues around sex and gender identity, can understand what has happened in a particular story or event. In general, this will mean using terminology and language which is clear, accurate and appropriate to the context. This may sometimes result in using words or descriptions one side or another considers problematic but should not be taken to imply the BBC is endorsing one perspective. In the case of the article about the outcome of Mr Linehan’s trial, the gender identity of the person he was accused of harassing was directly relevant to the charges he faced. The judge acknowledged this in their conclusion. The judge also referred to Sophia Brooks as “the complainant” throughout and used gender-neutral pronouns because of the different terminology adopted by the prosecution and defence. It was, therefore, editorially justified for BBC News to set out Ms Brooks’ gender identity so readers could understand a key aspect of the case. … Image 3 The wording used in the article was not, in my judgement, presented in a derogatory or dismissive manner and it did not serve to undermine the rights of trans people. I think it is reasonable to assume most readers will understand “biological sex” to refer to characteristics, such as chromosomes and anatomy, which are taken into account when a person’s sex is recorded at their birth. I appreciate you may disagree with the approach adopted by the BBC but I hope I have been able to explain why the wording was appropriate in the context and consistent with the BBC’s editorial standards. It helped to ensure all readers, whatever their level of familiarity with the subject, could understand an important element of the case being reported. There is no further right of appeal against this decision within the BBC’s complaints process. However, you can ask Ofcom to consider your complaint and the BBC’s decision. Information about Ofcom’s role regarding BBC online material can be found here but in summary, if Ofcom thinks your complaint raises a potentially substantive issue, it will give an opinion on whether the BBC has observed its editorial guidelines.
