Agreed, but we also shoujld NOT dismiss Trump's stated desire to cancel the midterms. Not because he has a lgal way to do so, he doesn't, but because "he wants to cancel midterms" is an accurate and useful statement of Trump's intent, NOT a statement about his lawful powers.

I understand that the law is also an historical discipline, but we don't study all of the other old tort claims. Hell, we barely even ask students to study causes of action that are still valid in MANY states.

I know that your practice here is consistent with many other professor's, but WHY do you spend valuable instructional time on a tort that has been largely abandoned? Do 1L's respond to the prurient nature of such cases? Is alienation typical/representative/instructive in understanding other torts?

I've never planned an ulawful seizure of the aparatus of government, so I don't know. All I'm saying is that Trump has never looked at a problem said "there's no mechanism so I can't do that," and walked away. E.g., in 2021 there was no mechanism for him to stay in office, so he tried to invent one.

I appreciate your thoughfulness here, and I agree with much of what you said. However, the loack of an existing mechanism does NOT prevent the invention of a new mechanism. You are right, it is not so simple as "cancel the midterms," which just means the coup will be more complex than that.

Thank you for the thoughtful answer. I do not agree with the "enemies of my enemies" strategy. We are in our current position in substantial part because American political theorists face absolutely no accountability for being wrong. And Bill Kristol has been fatally wrong, many times.
