Trump tariffs are illegal.

Congress controls tariffs just like tax rates.

President can change a tariff only for national security emergency, meaning war.

The greatest political scandal today is not what Trump is doing. It is the fact that congressional Republicans have given up their role in the constitutional system as a check on the executive branch. If we are in a constitutional crisis, it is as much on Mike Johnson and John Thune as anyone else.

This is false. The power of the purse is meaningless if the executive can simply disregard the appropriation of dollars is the law. There are numerous specific textual bases for this claim. But the mere logic of the document and the structure it creates makes this emphatically clear.
Chip Roy endorses impoundment (which is illegal): "All the powers our founders gave were invested in the executive, in the president. POTUS has the ability to go forward and say, 'we're gonna spend this money the way we're supposed to under the law.' There's no requirement he spend every dollar."

Any four Republican Senators could stop this at any time simply by threatening to block all action (or even caucus with the Democrats) if Trump doesn't make certain concessions. They won't, but that should be a much bigger story than whether the Democrats are doing everything that *they* can.
