Here are some things that may necessitate changes to your plan:

- Changes in assets
- New or sold assets
- Births
- Adoptions
- Deaths
- Receive an inheritance
- Divorces
- Marriages
- Move to a new state

One of the joys of owning and managing a business with my spouse is that I’ll frequently talk to professionals, clients, prospects, etc. who will RAVE about him to me. Since we have different last names, they usually have no idea we’re married.

The elder law attorney in me wants to remind y’all that winter and the cold are typically really hard on seniors and older folks.

Consider helping family, friends, and neighbors this time of year. Here are a few practical ideas:

People fight over money in estates all the time, but I have seen people fight over things like:

- Mom's jewelry
- Dad's guns
- Grandma's (low mileage) car
- Grandpa's (rusty old) truck
- Mom's holiday decorations
- Dad's tools
- Grandma's bedroom furniture
- Grandpa's coins

More law schools should offer an evening program.

The seven of us below went through (read: survived) an evening program while working full-time. On top of working, some were married and/or had children.

I’ll forever be an advocate for this type of program for many, many reasons like:

Estate planning is not just about “putting a Will together.”

Rather, it involves the estate documents + how you own assets + how beneficiary designations are setup + what you’re trying to accomplish (goals).

A helpful resource for folks in Indiana:

@IndyBar routinely hosts "Free Wills Clinics" for low income and low asset individuals. They define that as those who have an income level at or below 250% Federal Poverty Guidelines.

The next one is on December 10th.

Many people have lost a lot of money on it and many people have become addicted to it.

In fact…

I have a client who reduced their child’s inheritance due to it. The parents intervened. It was unsuccessful. Child has lost $25,000 so far in 2024 (that the parents know about).

Some of the hardest conversations I have with clients involve disinheriting children in their estate plan.

It is usually incredibly painful for them to discuss it. It's certainly not fun for me either.

Within the last year, my husband and I switched our financial advisor as well as our CPA. Both professionals were friends of ours — and were doing an okay job.

It was obvious it was time to move on and move up.

Had a prospective client call yesterday to get an estate plan done because she's going on vacation ... next week.

Most law firms are not going to be able to accommodate requests like this.

If you want an estate plan prior to leaving on a trip, get started *at least* 2-3 weeks prior to departure.

Don't let the sometimes-hard decisions involved in creating an estate plan be an excuse to not get a plan done at all.

That's not the norm.

A "Living Will" and "Last Will and Testament" are different documents.

We get phone calls from prospects that say they want to "update their Living Will" and really mean their Last Will and Testament.

This client landed in my office after an absolutely tragic thing happened to their family.

I was brought in by a personal injury attorney to help with creating a Trust.

It was incredibly important to me that we, the lawyers, didn’t make the already-awful situation worse.
