True, my sample comes from cases that end in conviction, and I also argue based on the favorable video when it exists. But I’ve seen many cases where the officer’s testimony contradicting the video carries the day. And appeals courts will often affirm despite video that they can also view.

Yes, that certainly happens, and I use the videos too. But I get plenty of cases where the video SHOULD win it but doesn’t through some combination of how it was taken or the court crediting what the officer says over what’s in the video (and the appeals court, which also has the video, affirms).

Absolutely! I do state criminal appeals, and all I see is body camera footage used to convict. And often the part that might be helpful to the accused is (take your pick) obscured by my coat, my partner didn’t turn his on, that first portion has no sound, I was facing away, etc….

Ridiculous to anyone who knows Charlotte. But the President has got the perfect visual to call for lynching by death penalty - without needing a full page ad in the NYT this time - and folks want to oblige in any way they can.

As someone who handles state court criminal appeals, Kav’s approach is both shocking and familiar. It’s of a piece with how courts wave away egregious search tactics in low profile cases. But here our highest court is doing it when the whole country can see the lie.
