In Lackey v. Stinnie, #SCOTUS made it harder for civil rights plaintiffs to recover fees as prevailing parties. But Congress can and should change underlying law, argues Cato's Thomas Berry, to designate a party "prevailing" if it wins a preliminary injunction before a case becomes moot.

Perceptive analysis of the (very early) morning, unprecedented order from SCOTUS on the latest, pending deportations. Anyone GenX or older, like me, will certainly laugh out loud at the reference to “Calvinball.”
Just before 1 a.m., #SCOTUS stepped back into the Alien Enemy Act litigation with a (remarkable) ruling that suggests, among other things, that a majority of the justices is tiring of the Trump administration’s Calvinball.
