Steve, why don’t we hear about the test introduced in Ex Parte Milligan? If civil courts are in session, no actual state of war can be said to exist, and restrictions on personal liberty cannot be imposed?

Harry, doesn't Ex Parte Milligan 71 U.S. 2 (1866) firmly establish that martial law cannot be imposed when civil courts are operating normally? As they are in Minneapolis and throughout the country? Why is there no talk of this test—"where war really prevails"—being applied?
