Dear Mr. Capus, Thank you for reaching out about your concerns surrounding Bill 9. As MLA for Drayton Valley – Devon, I would like to provide some contextual information to provide you with a response. In December 2024, Alberta’s government passed legislation to preserve the choices of children and youth, improve access to health services and protect children, families, and parental involvement in the education system. Since passing this legislation, three lawsuits have been filed by activist organizations, with one injunction already in place. Alberta’s government has been clear all along – we are prepared to use every legal and constitutional tool available to protect the health and well-being of children. If passed, Bill 9 the Protecting Alberta’s Children Statutes Amendment Act, will invoke the notwithstanding clause to: preserve the future choices of children and youth strengthen the role of parents as a child’s primary caregiver ensure fairness and safety in amateur competitive sports. Alberta’s United Conservative government will be unapologetic in our commitment to these principles. These laws will stand without further court delay or uncertainty. We cannot allow this legislation to be paused throughout lengthy court proceedings – potentially putting children at risk for years. The notwithstanding clause is meant to balance power between the courts and democratically elected governments. Albertans expect us to do this, and this is what our government will unapologetically defend. The notwithstanding clause is a legitimate tool that will ensure these protections for children stay in place. Using notwithstanding clause is a necessary measure to ensure that laws safeguarding children’s health, education, and safety cannot be undone and that parents are fully involved in the major decisions affecting their children’s lives. It is a tool that is built into the Canadian Charter of Rights and Freedoms for federal and provincial legislatures to use and reflect… Thank you for reaching out to the government of Alberta about teacher bargaining and Bill 2:　the Back to School Act. It is our pleasure to respond. 　 We know many families, students, teachers, and school leaders were feeling stress and uncertainty about Alberta’s teacher negotiations.　 　 The last proposal put on the table by the ATA demanded an additional $2 billion from government. This offer by the ATA did not present a path to resolving this dispute. On October 16, 2025, the Provincial Bargaining and Compensation Office (PBCO) wrote to the Alberta Teachers’ Association and formally requested an agreement to end the strike and enter an enhanced mediation process. Negotiating would have continued with the ATA,　the Teachers’ Employer Bargaining Association (TEBA), and a third-party mediator working together to come to an agreement. This would have ensured that students promptly returned to classrooms and that teachers returned to work.　PBCO made this offer to the ATA because the union had not made a reasonable offer, and this ongoing strike was continuing to harm students. This deal would have meant teachers could bargain on better terms for their agreement, and our kids would have been in school weeks ago. Alberta’s government was trying to put kids first and bring an end to the strike. 　 However, the ATA said no. 　 We support our teachers and want the same things as teachers: more support for teachers, smaller class sizes, higher pay for teachers, and more classrooms. However, the strike went on too long, and we were extremely concerned about the impact of labour action on our kids. 　 Every day of the strike, students lost critical instructional time, routine, and support. It set back student learning and deepened achievement gaps that cannot be overlooked. Our priority was student learning and supporting families through this challenging time. To prevent long-term irreparable damage to our kids and their education, the government legislated the teachers back to…

In your mandate letter from the premier, she asks that you “ensure the full implementation of the Fairness and Safety in Sport Act using all available legal and constitutional means necessary.” Does this include using the Nothwithstanding Clause? The Fairness in Safety in Sport Act (Bill 29) is unconstitutional as it stands - I can’t imagine any court in Canada propping up a bill that actively discriminates against transgender, non-binary, intersex and gender diverse youth. It is also the antithesis to the findings of the International Olympic Committee’s 2021 “Framework on Fairness, Inclusion Non-Discrimination on the Basis of Gender Identity and Sex Variations”, which advises sporting institutions to ensure that “athletes are not excluded solely on the basis of their transgender identity or sex variations.” Sports are full of natural advantages that biology provides, regardless of the genitalia someone was born with or how they identify; to legislate against that is to legislate against nature itself. Lastly, I noticed your office phone number (780-427-3070) has disappeared from the government website. Is there a better way to contact you directly or are we not supposed to be able to contact UCP ministers by design? Thanks, Jon Capus Email 2: Hello, It has been over two weeks now without a reply from the Ministry of Tourism & Sport. I will ask once more: does Minister Boitchenko plan on invoking the Notwithstanding Clause to uphold the "Fairness in Safety in Sport Act (Bill 29)"? In that time, not only has Minister Boitchenko's direct phone number (780-427-3070) disappeared from the Alberta government website, it now seems like the email contact (ts.minister@gov.ab.ca) has also been removed.
