And I guess more specifically, I’m wondering if a lot of these cases are getting decided in immigration courts with really lax evidentiary standards, and then when they find their way into federal court either by appeal (tho idk how common de novo review is) or habeas, those judges aren’t having it

It seems like bad evidence that can’t stand the muster of an article III court is a common thread is many of these cases ( Brinkema’s eviceration of the pure hearsay etc). Is that generally true or just a coincidence? I know they don’t follow the federal rules of evidence in immigration court.
