which is an interesting but apparently unresolved constitutional separation of powers issue, and if it can, how it could practically do so. There are competing considerations involving integrity of the judicial system vs. prosecutorial discretion in whether to purse a case (an executive function).

Seems relevant today. It leaves unanswered the question whether the courts can force the executive branch to prosecute a case that it wants dismiss (2/3)
