It's intentional. He needs a reason to viably declare martial law. Starting a war then saying "millions of Venezuelan terrorists are in the country" is all the justification he believes he needs.

Oh, and for your consideration, international treaties signed by the US that carry rules and laws are considered *US* law as well.

This is set by Article VI, Clause 2 of the Constitution, stating that treaties are the supreme law of the land.

It is commonly referred to as the Supremecy Clause.

Actually, yes, he will be breaking the law by attacking Venezuela.

The War Powers Act has a provision that allows Congress to review military force POTUS takes without a war declaration.

And there are OTHER laws he will be breaking as well. Those are independent of the War Powers Act.

This abject cowardice has caused Congress to give away almost all their power over the years, to become a true "do-nothing" institution.

The average congressman has a tier of priorities:

1: re-election.
2: re-election.
3: re-election.
4: personal enrichment.
5: personal power.

In that order.

Currently yes.

But understanding the context by which that law came to be is important.

It was not done because Congress believes POTUS needs it. It was done so congressmen wouldn't have politically risky votes on the record that may threaten their re-election.

That's not a constitutional power.

Congress created that law so they could avoid having to vote for/against war declarations, which look bad and would certainly cost them re-election.

Everything in the current situation points back to that, confessional cowardice giving POTUS additional powers.

This is the result of a century of political cowardice.

Congress had all these powers, but to have to avoid voting to use them and thus angering constituents they instead gave the president those powers so they could not have to make any hard votes and win re-election.

And they don't want it back.
