In Trump v Orr Scotus already said they dont think classifying transgender people as their sex at birth is unconsitutional. They are wrong just classifying trans people as their natal sex can be unconstitutional discrimination but when you add differential treatment that confirms it.

Odd how nonviolent protesting is terrorism but the goverment shooting you in the face or beating you up isnt.

Thats really the crux of it because they think its justified no scrunity and because the subclass is too few they dont believe they need to apply means to ends scrunity to people even thought equal protection applies to individuals.

In America if u film the dear leader's secret police and insult them, they will push u claim u attacked them by swipping their push away then beat u up. Then the judges will say the legal thing to do is let them beat u up so u can file an lawsuit and have it thrown out on a technicality years later.
