As far as actual prosecution goes it's rarely ever been enforced, but they could absolutely use it against you if they wanted.

Oh hey, I know this! It was from obscenity laws back in the 70's. The position of our delightful government is that any more than 5 sex toys indicates intent to sell them, and selling them is obscene. Obviously it's a way to extend control (over mostly women).
