I understand all that. However, I don't understand why the judge would give any consideration at all to this excuse for delay from the prosecution. It is entitled to none.

Let me put it a different way. The disorganization of the prosecution is not a basis to deny the defendant of his Constitutional right to a speedy trial.

Exactly. That's bullshit. When the prosecution brings a case the expectation is that it is ready for trial. The prosecution is not entitled to discovery delay. Period.

I'm sorry, but isn't the standard supposed to be that when the prosecution brings a case it is already ready to prosecute the case? Discovery and investigation is done, seem to remember hearing that somewhere. Like law school.
