Just now: In 3d Circuit argument over whether Alina Habba was properly appointed, Circuit Judge D Brooks Smith asks whether govt's theory isn't a "complete circumvention of the [Constitution's] appointments clause"? (Reagan appointed Smith to DCt; GWB appointed him to appeals court.)
