1. Public lands are set aside for recreational and commercial purposes.

2. Recreation generally doesn't require a permit - excluding designated wilderness areas and cutting a Xmas tree for personal use.

3. Commercial uses require permits. Always.

Her refusal to just say "No, there are no such photos" was obviously driven by her desire to avoid perjuring herself.

If this testimony was given at a trial, the jury would likely be instructed that her refusal to answer allows an inference that, in fact, she saw such photos.
