I agree that the STATE of the law is inadequate to the moment, and that will exact a cost from us. I also think that if we stick with it, the RULE of law will eventually come out on top. In other words, keep acting as though the law matters, and it will.

We're not even getting to qualified immunity yet. This is whether or not the resident is risking criminal liability for passively and verbally resisting entry into her home unless presented with a warrant. Refusing to open the door is, in most folks' minds, legal. There could be an exception 1/

Sure. All of this is to say that Marshall's dissent in Santana SHOULD be how it works. If ICE/CBP choose tactics that create exigencies, they shouldn't be allowed to invoke the warrant exceptions that might arise. Especially when many/most of the folks they are arresting don't have criminal records.

I don't think he's misstating the rule I think he's misstating the exception that might apply during the ICE operation. It would hinge on an LEO being will to swear after the fact that he saw the fleeing alien commit a felony before entry into the stranger's home. Once they get that figured out...

Agreed, but in Minneapolis, right now, the exception could very quickly become the rule. It certainly seems to be the policy. To wit: "Obstruction and Harboring are felonies. If you see a suspected alien flee into a home, the homeowner is committing a felony, so storm the castle."

It seems to me that an LEO is willing to testify that they observed a felony outside a home can force entry in pursuit of the alleged felon. In the current context, this doesn't seem like a high bar. Marshall's dissent is how it SHOULD work, especially the part about creating the exigency.
