After living 2 years in the US my kids know the US constitution much better than the Swedish constitution or the European convention on human rights.

Judge: That's what I'll do. Prohibit federalization or deployment of any NG troops into Oregon. For all reasons in prior opinion. Deployment of federalized military is ultra vires and contrary to law, violating Title 10, section 12406. I also find it's likely that defendants violate 10th Amendment.

In light of the extensive documentation of violations against POWs, the Mission would encourage the OTP to pursue investigations into these violations, with the aim of securing arrest warrants, prosecutions and convictions, if the evidence is sufficient.

The Mission also welcomes that the Office of the Prosecution (OTP) of the ICC is investigating the situation in Ukraine on the basis of 41 State referrals received. The OTP’s investigation includes allegations of war crimes and crimes against humanity committed on the territory of Ukraine.

The Russian Federation should cease arbitrary executions and all forms of torture or ill-treatment directed against Ukrainian POWs, ensure humane detention conditions for them, and grant the ICRC full and unfettered access to all detention facilities.

The Mission formulated a set of recommendations addressed to the Russian Federation, Ukraine and the broader international community. Among them, the Mission would like to highlight the recommendations to the Russian Federation to immediately recognize Ukrainian detainees as POWs.

These violations may constitute war crimes and, in some cases, arguably, crimes against humanity.

In conclusion, the Mission finds that the Russian Federation has engaged in widespread and systematic violations of IHL and IHRL in its treatment of Ukrainian POWs, including arbitrary killings, torture, ill-treatment, denial of fair trial rights, and unsafe detention and transfer conditions.

Conditions of detention frequently fall below international standards, with overcrowding; unsanitary facilities; inadequate food, water, shelter and medical care; exposure to contagious diseases, and forced labour under unsafe conditions or frequent transfers between facilities.

The available evidence suggests that torture and ill-treatment of Ukrainian POWs is a pervasive practice, directed or tolerated by the central authorities of the Russian Federation.
