They know their audience well. The Fox news watchers know TdA is bad (a "gang" and sounds Spanish) so the DOJ throws it in the indictment and then the Fox personalities can point it out.

Wish Garland would have gone faster, but I think he went slow and by the book because he wanted to make sure anything they charged and convicted on was irrefutable. Smith kept getting stalled by the judge in the case that made everything move painfully slow because she could. She ran out the clock.
